Legal advice please

Post by Amosu » Mon Nov 28, 2005 4:54 pm

Anyone here have any legal knowledge please? I'm after some advice on how to pursue a road traffic collision with a pedestrian when you are the injured party - or more specifically how you get legal assistance without having to pay as the driver was at fault?

This is what I know - details taken from my dad (the injured party).

Very bad icy conditions on the road this morning (Cornwall) out in the country. My dad is staying in a cottage way outside of town down a very narrow road where there is room for 1 car with passing points in various places. Just outside the cottage is a small bridge to cross a stream. There is no footpath, so if you walk, you have to be on the road.

This morning he woke up to find a lot of beeping outside and when he went to investigate, found a little disabled old lady in her Micra. She had got over the bridge at which point she had hit a patch of black ice and her car was stuck due to no traction.
My dad goes about trying to help her, telling her to put her car in reverse (pointless going forwards with no momentum and he starts pushing from the bonnet. He then hears something approaching behind, turns round and spots a Range Rover barreling down the hill at some silly speed for the conditions. Said Range Rover slams on the brakes - on the ice - at which point the wheels simply lose all traction and goes into a slide. Luckily my dad managed to get himself to the side of the Micra at the exact moment the Range Rover crashes into it. A lot of the impact was absorbed by the Micra, but even so it smacked into my dad and the impact was enough to send him flying. To give you an idea of how bad it was, the Micra is a complete write off, with part of the engine block now residing inside the passenger compartment…!!!
Luckily the old lady doesn't appear to be too bad off, but my dad has some pretty bad bruising, whiplash etc

If he had been in a car, his insurance would likely supply legal assistance to pursue a personal injury claim, but as he was in effect a pedestrian, I'm not sure whether this qualifies or not? Anyone have any suggestions please?

Maybe your Dads house insurance will pursue a claim?
Legal Aid via a Solicitor?

Not his house - it's my uncle's. Pops is not normally resident in the UK - only here on vacation at the moment :( He has AA membership, so I asked him to call them and see if they offer legal representation

Holiday insurance? Any coverage via any credit card that may have been used to pay for the holiday?

This is a job for a Solicitor......... most of whom will take on cases like this on a no win-no fee basis, only observation I can make is that as it was the micra which hit him, he will need to claim from Old Dear's policy, her insurance in turn, will claim off Mr Speedy's policy........ messy...........

Sorry I meant that the range rover hit the micra and bounced off it hitting my dad, so the micra isn't to blame :)

Pops is speaking to one tomorrow so hopefully will all get sorted pretty quickly, although mine dragged on for 3+ years after 2 cras crashed into mine with other drivers at fault O.o
