Cheers guys, should be enough info to get going - been asked to give it a week or so before we do anything as there could be some movement soon, just keep us updated on any progress (or not)..... I suggest we give him till the 13th then we will start the process
Anyone who is still out of pocket by then, but does not want us involved in getting their money returned just let me know.

Well Monday/Tuesday was promised as the point where refunds would be arranged, and so far today, I have been calling all day and have had no response. I'm always willing to give people a second chance, but having given third forth and fifth chances, I'm all out of willingness now. I think it's time we move forward with other methods of getting this money back as I for one cannot do without it any longer.

What cheques? Last week he said he was transferring the money this week, now he says money won't even be in his account until the end of this week. This is getting ridiculous, and embarrasing for me. I have a set of coilovers installed now and owe the company I work for the money, but I've had to tell them to wait until payday (which I'm sure will come around faster than we see our refunds).

I've spoken with my solicitor who says we need as much info as we can get on the person we paid the money to (Y Bogosyan) to then be able to sue to get the money back. If anyone is arranging to get their money back, I would recommend doing it through a bank transfer so there is an official record of it happening incase anything goes wrong.

Thanks for the pm's and updates guys, tomorrow is approaching fast and I said we should give him this long at least to sort people out. Come Monday, obviously with all of your support, I can start the process TWH has indicated thru his solicitor (but without the fees coz I'm a nice guy
).
First step is to go into detail as to whether an individual or company was paid the money (former from what I've been led to believe), and then start a joint petition to the court to wind him up if indeed he isn't already insolvent. We do this all the time thru our construction dispute business and it is neither difficult nor expensive. Normally the threat of such a petition, which can mean property etc will be charged to the debt, is enough to start seeing readies. If he is already bankrupt, then there are other ways and means especially when the dealing is fraudulent.
Probably the quickest way to resolve this is the next guy (or two) who actually meets him should take his car as security for the joint debt - that normally works a treat and you are well within your rights
Let me know how tomorrow/this weekend goes and how you would like me to proceed.

We all paid into the prvate bank account of Mr Y Bogosyan - I suppose he should be liable?
JNS Performance was already dissolved before any of these transactions occurred.
I think it should be fairly easy to prove that we never dealt with JNS Performance on any level
until the receipts arrived.

It's accurate to say this started life as a personal purchase and is very easy to prove. Incidentally any receipts received which indicated any association with a ltd company that has been dissolved will I am sure prove to be a case of fraudulent behaviour - something that can get you a long stay in a free room at 'Her Majesty's Pleasure'.
I would be interested to know how easy it would be to get hold of John's car as security, or even liquidate it to pay for refunds. I am assured he has a very nice R32 which should fetch some pennies. Think he also has another vehicle so thre should be no nonsense about tools required for livelihood and such diversions.

Depends on who owns them.
