Yes the Audi started it, but I come across dick like him (mostly in Audi's) everyday (I'm doing 1000miles a week at the mo) and you just have to laugh at their ineptness and get on with your life safe in the knowledge they are retards .... The cyclist just proved he was a bigger <beep>

It's assault, pure and pretty simple. Even given the threatening language from the cyclist, the passenger/drivers were under no physical threat, duress - yes, but a threat requiring self-defense, no.

This just kicked back at me from our pet barrister:

A lot would depend on the level of injury that was caused to the cyclist but this is likely to result in a conviction for Assault and Battery, alongside a plethora of minor driving offences. Presumably the Audi driver wouldn’t be so stupid as to plead not guilty, given that he has been caught ‘red handed’ so to speak, in which case his sentence would be somewhat reduced but I foresee a sentence of a community order with some sort of driver training requirement attached.

Above all, what an absolute <beep>.

Nobody has mentioned that the Audi driver supposedly ran over the cyclist foot? Atleast thats what the cyclist was confronting the driver about.

If you freeze frame the video it reveals the Audi driver is not guilty of assault he is still in the car and the guy who carries out the assault gets into the car via the rear passanger door. If i was the driver i would plead not guilty and when asked who the passenger was my reply would be i can't remember Lol.

I'd already pointed that out to our pet barrister, his actual response was "but it's a coupe, I only counted two doors". Nup.
Doesn't matter he said, it's still Assault and Battery.
The case would depend on who the charges were brought against by the cyclist, if he was smart (or more importantly, if his lawyer was smart), he'd pick his battles i.e he'd go after the guy who clocked him. If you were the driver, you'd have to present a pretty good reason as to why you didn't know who was travelling in the backseat of your vehicle. Otherwise, hindering a police investigation can get kinda nasty.
