Caught speeding at 107mph....

Going down a dual carriageway Eastbound (A420). On the inside lane nothing in front of me and I stretch the car in 6th and back off. At that a geezer in a luminous green jumper jumps out of a hedge, I brake and think - "he is going to run out in front of me". As I approach I realise it is PC plod.

I pull up at the next roundabout and a panda car is sat on the central reservation. They pull me over and ask me why I was travelling so fast. Being a little lost for reasons I simply say, I can't come up with a sensible excuse.

I get out of the car and walk to the central reservation where he proceeds to take notes on a large A5 sized flip pad. There is no official police documentation at all.

A junior WPC is there and it would appear she is in training. Only one of the 4 have a white cap on. He takes down my name, address and other details and says he could offer me a fixed penalty but as it is over 100mph, he can't. He asks the WPC to check my details and she comes back shrugging her shoulders and obviously had not checked everything. I butt into their conversation and inform them that the car has only been with me a week and the paperwork is in the post but that it is insured etc. He says he'll complete the paperwork over the next 4-5days and tells me to go.

I have a few concerns:
1) The way the whole matter has been handled. PC jumping out of hedge etc
2) No official paperwork was used to take notes etc
3) They did NOT complete the checks on the car properly. The V5 paperwork is still in my drawer at home.....waiting to be completed and sent off
4) I was not given anything (producer etc) or asked to sign anything
5) 4-5days for Police paperwork to be completed

Anyone got any thoughts, had anything similiar or qualified to comment?

If you were not asked to produce documents then i think your OK
In fact i dont think the have a leg to stand on
Although this thread is kinda admitting it..
So i can move it if required

hi,

If you do not receive a notice of intended prosecution on the spot and you will recall as it it is like a caution then you must receive it in the post within 6 months. If not you in the clear!

If you do then pls pm me and I will give you the name and no of a clever all be it expensive man who helped me get off with 114.9.

If they don’t do it right they can not have you, if they did then go with good defence and don’t worry......

No body died the worst they can do is take your license and then there are ways of using loop holes to get it back early.

Guys. I spoke to Freeman. Basically all I have to wait on somehting coming through the door. There are lots of genuine mitigations that need to be taken into account but in the interim I have been asked to provide a statement. Here it is.....

At approx 13:30 on 17th April 2010 I was travelling eastbound on the A420 on the dual carriageway (70mph zone) stretch towards the Kingston Bagpuize roundabout. I was aware of a deep red coloured VW Golf immediately behind me and some other cars behind the Golf. As I passed under a flyover, I became aware of a person in a luminous jacket jump out of the hedge on my nearside, approx 500m further up the carriageway. My initial thought was “there is an idiot about to try and cross the dual carriagewayâ€

Hope it comes to nothing Rob. That road is notorious for speed traps, my mate got 9 points for doing 140 in his boxster!!

Sorry to be the bearer of bad news but that's incorrect. A few years ago i was travelling at 124 mph when i was caught in a speed trap by an officer on his own in a Volvo with a radar, he pulled me at the next junction and verbally informed me that i was in the brown stuff!

He asked me how fast i thought i was going to which i replied "not that fast" this went on for a few minutes and i politely asked him if i was under arrest to which he replied "no" he verbally informed that his car was equipped with calibrated radar equipment combined with an in car video recording system, he verified my details, told me to expect a summons and sent me on my way.

I took legal advice the same day detailing the events almost word for word, my legal representative said there could be mitigating circumstances i.e need to drive for work etc... my legal advisor told me not to expect an N.I.P just to expect a summons because the officer had verbally informed that he was reporting me, the only thing i could hope for was that i got lost in the system as i was never given a ticket or asked to produce any documents etc... i had been provided with detailed legal advice regarding the process and could only hope that i did'nt receive a summons or at least any paperwork within six months of the 'alleged' offence.

Every morning for almost six months i woke up wondering what the postman was going bring for me, time went by, 1 month, 2 months....... 5 1/2 months, 5 months & 3 weeks..things were looking good, i was thinking i'd been lost in the system until on the last day before the six months was up the postman kindly brought me summons that had been issued a few days earlier. I passed this on to my legal advisor let him read it, he checked the statement and confirmed my worst fears the accusation was watertight. I went in to the court telling the judge loads of things that he had heard before, i needed my car for work, i could lose my job, i was really sorry etc.. but ultimately he pointed out that an offence had been committed and there was no explanation that could change the fact that i had broken the law (i never once admitted the offence until the court informed me that they were in receipt of the video footage which i asked to see)

Anyway i was found guilty of traveling 124 MPH on the A14 on dry afternoon, i was at the time a driver with a 'checkered' driving history having previously totted up to 13 points (yes 13!) for speeding related offences and also having been previously convicted of a DR10, things were not looking good i was clearly a motorist that liked to break the law, and one point my arse was twitching like a fiddlers elbow when i realised that this time i had probably overcooked it a step to far and could possibly be looking at a custodial sentence for my continued driving offences.. this was it, i was going down, not a nice feeling! I was'nt after all criminal i just liked driving too fast but the bottom line was i had done wrong! The court retired to consider my sentence, i stood in the court, waiting for my punishment, the court returned asked me to stand, my heart was sinking, i felt physically sick... The judge gave me a proper bollocking, he made me feel like a criminal, my liberty was in his hands, i stood listened to what he had to say, the room closed in, his final words were " the sentence for this offence is a 6 weeks disqualification and a £350 including court costs!" A six (6) week ban i could have jumped for joy, i felt elated!

Since then (2002) that was my last motoring offence and i've had a squeaky clean licence since! A lesson learned!

this went on for a few minutes and i politely asked him if i was under arrest to which he replied
Dont think ive ever known anyone being arrested unless under the influence

Apart from that have you heard anymore

Still not heard anything but they can take upto 6 months and in fairness, most people comment that they get paperowkr though days before the 6months is up.

A friend had a similar situation going well over 100, I think 125ish and received his summons in the last week of the 6 months, so cruel! I think he got a similar ban and fine.

I was stopped this year (last year now actually!) on Christmas day going 110 and they let me off scott free! It was the best Christmas present ever. I've had a clean licence for about 8 years and I was gutted to get stopped, a lesson learnt, sort of ;)

My 118mph appearance was notified to me nearly 6 months after the offence. I hated the waiting.

p.s. 25 days and £250 ..... although this was 1995/6 so things have changed.

p.p.s. I was in a 1.8 Mondeo. :roll:

A friend just had 24 days and £500 for 110mph. Notified a few days before the 6 months was up.

Many moons ago I was stopped doing 108mph and got 6 points and a £480 fine so it's not an automatic ban (the court apprearance was over in a month from the time of being stopped), and I was going much faster but the Police Omega couldn't keep up to get a VASCAR reading (thank God!). The officers were MAD though!
