Depending on the petrol station, you want to get the request in as soon as. My missus runs our local Total and they keep a rolling month to hand before they are recorded over (although its now a hard disk based thing rather than tape, they just burn off a cd/dvd with the bits that the police etc want from the machine easily enough).
To honest, she would just let you take a look at it if it was her garage due to knowing that it can take the police MONTHS to actually get round to it. We have a pile of tapes in our dining room from a case dating back over two years ago (when she was area manager) for the theft of 10's of thousands of pounds...they still haven't even looked at them or prosecuted :bash:
You pay your insurance company to do this job for you, get them working for the hundreds that you pay them a year. Also if you are a member of any motoring association (including RAC or AA) get on the phone for your included legal assistance.

I think you're on the right lines here with your letter. I'd add that you should probably call the switchboard and get a name for the guy who heads up the fraud department. Make sure he get's a registered copy of your letter and follow up with him by phone so that he can understand that you're a real person. Don't forget - it's his own insurance company he's trying to defraud as well as yours, so you should be writing to them also. They'll be in a better position to investigate this as he will have had to have given plenty of info in order to take out a policy. They might find for instance that he doesn't have mini-cab insurance - 0nly SD&P..

Additionally - if it were me I'd phone the minicab driver and let him know that you have all the evidence that you need to prosecute a charge of fraud, and that in addition to notifying HIS insurers. You'll inform the police, providing them with video evidence etc.

Give him 7 days to drop the claim and don't get involved in any discussion. Just make sure he gets the message that your onto him.

Did you follow up with Woody? I sense he might have an ace in the hole.

There's no reason why you shouldn't come out on top if you show some gumption.


PS - I think you have a very poor chance of getting useful CCTV footage. I work in the industry.

Thanks for the feedback on the letter lads. I sent it off last night (with the recommended amendments and aditions) via email, and via post this morning.

Now just to wait for a response from my insurance co.

Travs & Bobbler, unfortunately I personally cant request the camera footage. It has to come via my insurers. But for that Im gonna push em to the max to request it. If they dont Im gonna kick up an almighty fuss ;-)

Misternomer, good idea about contacting the t1t directly. If I can bluff him into believing I have the footage ;-) But realistically I cant see that happening. I sent Woody the guys registration and cab registry number. Hopefully he can pull some stuff up for me :)

If he is a serial t1t .. the the chances are he will know the law and that you can't legally have the cctv footage and therefore (if you had it) it would be inadmissable evidence.

Actually, I don't believe you should contact him at all. It should be done through the insurance companies, otherwise you can be accused of harrassing him. If they don't contact him, you accuse thme of negligence and take them to court for not doing their job.

If you do everything by making the insurance company your agent in this case, then you never interact with him directly, and anything that goes against you is their fault, and you get them for neglicence. The point is to make everything their problem, not yours.

Lads, you're both spot on. So far I've done everything by the book. And if I continue doing so, if the insurance co c0cks up I can rightly kick up a fuss. We all pay them large / ludicrous amounts of our hard earned every year (a lot of which is due to t1ts like the guy who stitched me up!!!) to protect us if need be.

Things regarding my letter were slightly were slowed down due to them giving me an incorrect email address. But I sent them a hard-copy yesterday, and re-sent the email today.

Hi John. Sorry for not updating you lads. Alas, no real updates as such. Waiting for insurance co to call me today regarding the repairs to my car. Unfortunately, I got messed about big time by an Audi stealership. It took em over 2 weeks, and loads of phone calls and emails, just to send out the quote for the work that needs doing!!

One bit of bad news was that the insurance co managed to get the petrol station to look at the CCTV footage around the time of the accident. But unfortunately the CCTV cameras JUST miss the area where the accident took place. The only thing they did catch was of both cars pulling into the petrol station. S0ds law hey!

Now they are trying to obtain footage from the traffic cameras. Fingers crossed.

When you consider the police are investigating speeding crimes via Youtube videos, its not a wise thing to discuss in the open so to speak...that's my tuppence :D

I know prosecutions have occured due to pictures of cars checked against DVLA databases on another forum I'm on, along with a couple of prosecutions from YouTube videos of bad driving. It's good to have police on the forum.

yes, especially with some people admitting they've done 200mph on the M621 at 2am in the morning :lol:

Update:

There has been some development in terms of the other party. I don't want to say to much on here just yet... just in case! But again, fingers crossed.

Also, I'm quite hopeful of my insurers obtaining the traffic camera footage. If they do manage to get this, it will clearly show what happened and hopefully the other party will get what he deserves :)

In terms of getting my car fixed - it's now down to the insurers assessors to overlook my quotes. But hopefully they'll allow me to go with the slightly dearer quote - which was with Pentagon. Hopefully they'll also give me a like for like car as my courtesy ride :)
