Warranty invalidated!!

Hi can you help im now the proud owner of a RS6 and it had an extended warranty from the last owner, i got the car trade so the new owner stayed on the log book whilst it was on there forecourt....


Now on the warranty leaflet it says "to transfer the warranty it must be done within 7 days of the sale of the car" (no exclusions that i could see) and when i called the Audi admin number which was on the warranty card this grumpy mare said because i didn't buy it private the warranty could not be transferred!!!!

I said the garage is not on the log book as an owner so whats the bloody difference? she still lead me to believe im screwed.... ive sent the card off anyway to transfer it but is she right !!!!

Just say you got the car from the previous owner rather than the trader. Then say the application was sent off in the post within 7 days but you have not receieved any confirmation yet.

It's the same with Porsche's extended warranty - it is only transferable to a new owner via a private sale. If the car goes through the trade, warranty is void.

Lying or playing dumb...I guess the chances of being found out are quite slim, but if the underwriters of the warranty did choose to investigate a big claim they wouldn't need to be Hercule Poirot to discover the truth, and you'd have left yourself open to charges of insurance fraud.

Isn't insurance Fraud when they have paid and subsequently find out the claim was frauduent?

If so, I have yet to have a job done under warranty where the dealer did not ensure the warranty company would cover the work BEFORE completing anything.

Its all weighing up risk though I suppose.

The cover has already been paid for the car for a fixed period of time.
Warranty company is trying to get more dollars out of the next owner by having a handover timelimit in the smallprint.
Serves no purpose, other than to line their own pockets.

If the warranty conditions are as suggested like the Porsche warranty, then you will need to get the balance of the warranty transferred over to the you (the new owner), by the previous owner as would be done in a typical private sale.

If the car has been traded to a dealer, and you have declared you purchased from a dealer, then I know in the case of Porsche's extended warranty, any remaining warranty is lost, however this is not an issue for the purchaser, as the dealer (Porsche) will put a fresh 12 months warranty on any car.

Its more of a wasted purchase for the previous owner as they cannot cash in any unused\remaining warranty.

This is definitely the case as a called again and he asked if bought it strictly private!! This time i said YES and he then said well as long as ive posted the check i should get my welcome pack!!! lets bloody hope so cause this list i have could get bigger.
My RS6 is an 04 and the list is, alloys bubbling, menu button on the centre console not working and the xenon washers aren't functioning as the water is dripping from under the bumper (lovely stuff)! if offered i would like to put the extra and go for the Plus alloys ... nice.…:biggrin3:

But presumably the warranty contract states that the warranty is applicable for a fixed time *unless* the car is sold to a trader (in which case it ends)? If the car is subsequently purchased from the trader, and the buyer lies and states it was bought privately, then he has committed a deliberate act of deception against the warranty (insurance) company. If he subsequently makes a claim against that insurance company to have repairs made, then he is guilty of making a financial gain via deception. I'm no lawyer, but how is that *not* fraud?

I still think the chances of being found out are small. But given how zealously insurance companies take the business of wriggling out of claims, it's not something I would take even a small risk of a criminal record for.
