As with most things in law it's what you can prove and not what you know or think you know. Taking Kevin's point one could just as easily argue that the delivery of a set of coilovers to one person was used as a credible inducement for others to part with their money.

The police will be duty bound to investigate but ultimately it will be the CPS's decision to prosecute. This will depend on how well CID investigate and turn up evidence. The mere act of the investigation may make some money appear as that will be the only conclusive short-term way of deflecting prosecution, else he will have to come up with some good reasons in his defence.

This action does not prevent you from pursuing the money civilly either so it's worth a punt.

Also, I have just spoken with citizens advice. I am going in tomorrow to dicuss it further with them.
Apparently, the fact that I have a bounced cheque is good. They can then put me on to a solicitor.

I am putting together a dossier of information I have. I would be grateful if those who have been
defrauded by John could PM me their contact details in case some corroboration is required.

Can we try and keep updates regular? Thanks.

Some points chaps

1. The police will not look to regain your cash, they will only see if their is a chance of a prosecution.

2. You need to think of using the "High Court" to make a combined claim. The recovery system is a lot quicker. When you obtain a judgment, the Under Sheriff is used to recover goods to the value. They are not the county court bailiffs who are civil servants, they are generally private baliffs, who have a better motivation!

3. In a county court you will not generally be allowed costs. If it is defended you will, at your own expense have to go to the defendants local county court to say your bit. Any legal advice will cost iro £120 per hour makes the main dealer look cheap!!

4. It will be first come first served in the insolvency, the crown, vat etc get first pickings then the great unwashed get whats left.

I have spent some time speaking with Andiroo. Andy thanks again for your time.

We have devised a strategy and wish to proceed outside of this forum.

I have created a private group where we can communicate on our plight.

If you do not wish to participate and you want to pursue this issue on your own then good luck. If you want to approach this as a group then please do the following:

1. Send me a PM with a private e-mail address and a contact telephone number.

2. State for the record what you were purchasing and how much you are owed.

3. Confirm when you paid for the goods, the method of payment and any other details (bank account payed to etc)

4. Add any other additional information - dates, conversations, receipts held etc.

If you are not owed any money then you will not be invited to the private group (RS246 moderators will be allowed access of course). Anyone who thinks they need access will have to be approved by Andiroo. When you register with the group you will be able to see the proposal Andiroo has put together. IMHO it's the best chance we have.

Can you please respond within 48 hours so we can proceed - time is a premium now.

FYI I anticipate we are running at around 6K.

Same geezer ran a similar scam on Edition38 forum. Kept making promises which were never honoured. Eventually got banned after weeks of excuses. Not sure what the outcome was though.

Edit:

Might be worth teaming up with the Edition38 team and going for the full whack!

OK, His username on here was Karyanis and he also posted as a16vkr. I am pretty sure a16vkr is his username on
edition 38 as well. Too many coincidences. He seems a lot f more active on that forum though until the end of Sept

On one thread he talks about purchasing a business in Florida - maybe we should expect shares in that for
our venture capital?.

I had a look for the threads (and there were quite a few), but seem to have been removed/vanished into wherever. His username was indeed a16vkr and his first name is John. 99.99% it's the same guy.
