The grey area becomes more black and white. The biggest problem here is that it means this case will have precedence for future ones.

I'd have to say that without the details I agree with the more legal comments in that this is nothing new but just... unusual to occur from a trackday.
It's no different to carrying a passenger on a track day - from a legal point of view its a total nightmare should anything bad happen.
