Caught Speeding.....

we were clocked a 94mph in a 70zone in a rental car over the border in scotland

i have 6 points my misses thinks she was driving:) and has a spanish licence

does anyone know how the court in scotland would deal with a euro drivers speeding? i only have a experience of english courts :)

i know most officers would let em off cos of the paper work.

also my first name was spelt wrongly on the NIP does this help?

any ideas ?

Your brave putting stuff like that on t'internet! Unless significantly wrong (i.e. someone else!) spelling mistakes don't make any difference, a guy at work had the wrong road details put on his enforcement yet the magistrate said that this made no difference, the fact was he was caught speeding.

If your after any serious advice, give that specialist Nick Freeman a call, not cheap though, depends how you value your licence. :wink:

Or both admit to the speeding offence? I think you'll find that as a car can only be driven by one person then if both admit the offence of driving at speed, they cannot by law prosecute a innocent person so the case must be dropped. You could ask for photographic evidence of who was driving as you can't remember and if both were insured and it was a hire car then they cannot prove who was driving or "should" have been driving.

I don't think they would bother trying to endorse a euro licence as the speed was below 100, so that may be another way to go.

On the name front, I don't think that would carry much weight, unless you were questioned in court. I got caught and they had my car detail wrong. An Audi B4, instead of Audi S4 Saloon as in the V5. It did not matter. However, if you are cross examined, they ask you, your name as per the NIP, you say Nope, thats not me....discredits the whole evidence procedure the police have and it is likely to be thrown out.

Speak to Mr Freeman, if he cannot practise law in Scotland, then dig up a Mr Beltramey Snr QC, he is in Glasgow, licensed to practise in both England and Scotland. My Uncle who was in the drug squad at Strathclyde Police used to hate coming up against him, he knows of cases where drug dealers have been photographed handing over drugs for cash, Beltramy has got them off......I'm not saying that is good or clever, but he is very good at his job...

Yep, I agree with Dippy, the are divisions setup to monitor all types of web sites and there have be prosecutions on the back of what people have post in forums.

I haven't read it, but I'm sure there is a post somewhere asking about how fast people have been! Did no one reply?

Also, I remember John Roberts saying he had his car upto 180mph odd and confirmed it on the GPRS after his mods :?

saying these things and proving them are completely different. I doubt the police monitor these kind of sites for speeding, for organised crime yes, but not speeding....

If you genuinely can't remember who was driving the car at the time of the alleged offence then it's fair defence (Hamilton v Crown). As long as you have done all that is reasonable to determine who the driver was then you can defend a s172 action against you.

It's unlikely that he confirmed his high speed via a mobile phone data-link technology....might be GPS instead ? ;)

thanks for the replys.

i think it would be difficult to identify the incident from the description.

I'll call freeman on monday and see if its worth lokking at squrming out of.

I've only 6 points and 3 come off in october

so i would have 9 till oct after proceeding if i dragg my heels could be eng of august or later should be ok

If you have not replied to the paperwork you have received I suggest you take a look at pepipoo.com which is a site dedicated to help for the defence of persecuted motorists. Thats us by the way. There is a suggested ploy in there which should work but it could of course be different in Scotland. I would have a look anyway.
