Cancelling an exclusive order - legalities

Wife currently has a C7 rs6.... We ordered an exclusive PE a few weeks ago (hurried along to avoid the price increase) and paid the 5k deposit. Being honest with the dealer I explained to them we were having some doubts about moving over to the PE as it's not going to be much of a change really for her except a fresh colour etc, and we would prefer to rethink the next purchase. Anyway, we have no build week and production is full until June. Problem is the dealer has said they may not be able to return the full deposit? They need to un mark the order as an exclusive so they can amend it to a spec they want. Surely an early order with no factory build can be stopped? The only paper work I have is the quote, no T&C's. Like to get my facts ready for the next call with them !

It would be unusual, in my opinion, for a dealer to retain a deposit for a car that is not physically ordered yet. Essentially your order is in a queue of orders. It really is not in the interest of the dealer to hang on to a deposit where there is no physical order or car.

I don't have any paperwork. We did it all via emails as I travel a lot. No mention of the deposit, just told with an RS6 order the deposit is 5k. I scanned and emailed the front order sheet signed. I hope it not an issue as we would want to order from them again in the future. No sense falling out over.

Not sure why there'd be an issue refunding the full deposit when the car clearly hasn't even got a build slot, yet alone entered the production line yet.
Playing devil's advocate though, why put down a deposit and order a car you're vocally unsure about?

Did you physically visit the dealership or was it all done via phone / email?

Good point, you have a formal, unequivocal 14 day call off if you did it remotely.

All sorted, full deposit back. Dealer happy to bring the order along for themselves.
