Generally it's not in the dealer's interest to retain the deposit. However, the contract you sign when placing the order is pretty clear, it is non-refundable.

I'd expect, in this case, the dealer to have a reasonability check.

Cheers for the positive comments guys , It would be nice to get the deposit back but I asked what options there was ( the deposit towards a cheaper model for example , SQ5 for example as we had one before ) would just mean less monthly outgoings and way less deposit but nope , their way or the highway so I think that's me finished dealing with them from now on .

That's a pretty shoddy service to be honest. If they still have the opportunity to cancel the car from being built, then common sense in keeping a long term customer would seem most appropriate.

Name and shame I say.

Difficult. They'll surely want to keep the build slot on a facelift RS6, and they can probably still amend the spec? So its strange they aren't being flexible at all - especially if you are considering something like an SQ5 instead

Unless the dealer is in one of those "if you don't shift X number of these units you will fall down the priority list of getting more build slots".

Perhaps they are trying to avoid that slippery slope, or indeed trying to climb up said list. If indeed such a list exists, which I'm pretty sure it does.

The dealer in question to be honest doesn't even need to try to shift cars . I do find it strange as we bought our last SQ5 from the same salesman , but as far as I am concerned I will not cross their doorway again .

Ah well guys the dealer came good in the end and will now allow me to use the deposit towards something else ( may even see if they will hold the deposit till this oil price farce begins to lessen ) , still gutted that I am not going to get such an amazing Audi , and to be honest I can't really think of another car that I really want .

Been offered a fully specced up competition pack M5 ( albeit without CCB,s) for £650 a month and 10k in but it doesn't flick the switches like the RS6

Yes. You'd have to be a bit of a fucktard to get pleasure from ordering cars consistently just to cancel them, however if i order something & then change my mind or my circumstances change then 100% i'd expect to be able to cancel & get my deposit back & i'm 99.9% sure the law agrees with me.

IF i was placing a special order (very special) then i'd expect a commercially aware dealer to tie me into a non refundable deposit & i've no issue with that as i'd be in agreement, however if i place an order for a car (built, to be built or even to be launched) then YES if i change my mind i want my money back & that's how it works. Twice i've cancelled an order & both times i got my deposit back (as expected).

I think you need to look more closely at the T&Cs of the order you place!

If the Purchaser cancels the order or shall fail to take and pay for the goods within 14 days of notification that the goods have been completed for delivery, the
Seller shall be at liberty to treat the contract as repudiated by the Purchaser and thereupon the deposit shall be forfeited without prejudice to the Seller's right
to recover from the Purchaser by way of damages any loss or expense which the Seller may suffer or incur by reason of the Purchasers default.

If the order has not been locked for build then I would expect the dealer to cough the deposit up, if it's locked down then they can stick to their guns.

If there was any doubt, finance offer back up, same as it was before, 3K Audi UK, 3K dealer, 6k total.

So if i read the above correctly, i walk into said Dealer & place an order for XYZ vehicle, handing over my let's say £1000 cash deposit. The car is then produced to my spec but as it's on it's way from Germany to the UK i cancel my order i'm good to get my deposit back which is what i said. However once the car is less than 14 days away from delivery i'm liable for both deposit & potential loss the dealer may incur by me cancelling my order?

Both orders i've cancelled & had my deposit fully refunded were before the cars would have arrived in the UK. One had most definitely been produced & had left the factory, however the other was probably just before production.

Mine was cancelled a few weeks before it was built, dealer moved it over onto the FL model no bother. Even though they had to take delivery of the other car because Audi Germany said it was too late to cancel it from being built - even though cars that were scheduled to be built before mine were able to be pulled from the build schedule. Bizzare.
