My F10 M5 Formally Rejected!!

Well this is a 1st for me, as although i've experienced faults in cars before i've never felt the need to take the ultimate step & reject a car, however with an exact replication of the misfire that originally took my car off the road for 10 days in November & the admission last week that the fix in November (fuel injector replacement on cylinder 1) was not a fully diagnosed fix as BMW had even after such a length of time in the workshop not been assured that the fault was injector related & therefore we're back to square 1 as the cylinder 1 misfire returned last Tuesday, just 1900 miles on from the previous failure & pretend fix.

In between times the car's been off the road for a couple of further days due to an oil seal fault causing a leak (replaced) & a wheel sensor fault (dealer initially found the fault but then couldn't replicate it so decided to ignore it & not investigate further), however it's the misfire that's led to my formal rejection as having now been brought home twice on the back of a low loader some signifiant distances, i've had enough & no longer trust this F10 M5.

BMW UK have accepted the rejection & the originating dealer (Stratstone Chesterfield) are looking to source another M5 as quickly & painlessly as possible, however neither are appearing very good at communicating & i've several times been expecting update calls just to be left waiting in the dark. As i took this car on BMW Contract Hire, BMW Financial Services are also involved as the deals available last Autumn have long gone, therefore BMW will be financially bolstering the deal. I'm still driving round in a bright red Diesel Manual Honda CR-V which BMW ES gave me last Wednesday, however i'm being told BMW are sourcing something more in keeping with my M5 from Group stock. Still to hear what/when this will be happening though.

To say i'm p1ssed off is an understatement & on Friday i made contact with Audi as was fully intending to demand a refund & swap back to a marque i have more trust in. I have of course had faults with Audi's in the past, but the whole dealer support (from my local dealer) & manufacturer customer service in my experience is a lot better with Audi than BMW (to date)

I've no idea how long this whole process with take & am still hesitant on pushing the button for another M5, this compounded by the fact i've only had 2 BMW M's (previous in 2006/7 was an E60 M5) & that M5 failed in spectacular fashion so i sold sharpish once the SMG transmission had been replaced.

I'll keep this thread updated with progress.

Hmmmm...I imagine its complicated by the involvement of financial services and the CH agreement...is the agreement and the roadworthyness of the car linked?

I.e even if BMW UK gave a full refund would there be further charges from BMW FS to settle the finance (which clearly you'd expect BMW UK to settle).

Ironically having a CH party involved can make things easier to reject. At the end of the day, their business is based on the goods being worth X at the end of the term. If they are not then it wipes out the margin they operate to. As such if the car is a lemon then they will want it sorted or rejected sooner rather than later.

In this case the Finance co is in house, so shouldn't be an issue...can see how it might get messy where they were unrelated parties.

Very true... But it's one of those things that pissing off a customer is bad... pissing off a fleet/contract hire place is unthinkable :)

As for the OP - wow that's some misfire to get it recovered. What were the symptoms? what dash error lights did you have on?

The misfire causes the car to go into limp mode which is kind of like driving a Massey Ferguson tractor & not a very pleasurable experience. Dash lights up with Drivetrain Fault, reduced power etc. & seek assistance ASAP. Fault sometimes clears on a reboot but quickly comes back. The Fuel Injector change in November did give me some comfort that they;d fixed the problem, but 1900 miles later the same thing happened & on the same cylinder. TBH, the logs showed several misfires but the focus was cylinder 1.

TBH it's a bit of both. Unraveling a CH agreement is more complicated than a LP, HP or PCP, however this is appeased somewhat by all parties being BMW so that should iron out some creases. That said, BMW FS has to be independent from BMW UK for Consumer Credit & Data Protection reasons so still not a perfect scenario.

I don't expect to be out of pocket as BMW UK will have to underwrite any losses that say BMW FS or a Dealer does't want to carry. How this will play out in real terms is another matter & also what will the new CH terms be, length of agreement, allowable mileage etc etc.

Which one as had quite a few & still got the Q5?

Looks like i'll be ordering the replacement M5 today & have just been told a brand new M50D is being dropped off for my usage over the next few weeks & that looks like quite the giggle of a car to play with:)

M50D in the brand new range is an X5 only currently (i think) as the X6 hasn't had it's facelift yet. Could be wrong but that's what t'internet says.

Unfortunately not:( Even with dealer support on RS6's now available this quarter, i can still only at best get a (fairly basic) S6 for the same money.

My ££'s brain says i ain't taking a £54k car for the same money as a £76k car as that's plain daft.
