Well ASM are refusing a full refund just a buyback amount, followed up with the threat of legal action if I continue to pester them.

Looks like we are going to court
Might be worth an initial letter from a solicitor stating you are going to court? Worth a try perhaps? Hand deliver or recorded delivery.

You are entitled to a full refund within the first 28 days, the garage owner will know this, and he'll also know if he goes to court he will lose. Quite a few reviews saying he/the garage initially plays the customers bluff by declining refunds (and offering a buyback instead etc) within the first 28 days....

The problem is this joker/company seems to create a new garage every 24 months or so. A quick google through companies house, for example....

Just frustrating as I want to give the car a good going over as it should be my new baby, plus the tyres are shot MPSS which are not good in this weather taking a bit of fun out of a car I have wanted for 6 years.

Going to give them one more chance in the morning as it is day 30 (last day by rights). They don't want it back how do they explain an owner for 30 days plus they have to fix everything as I will make sure when you Google the reg number it will list what is wrong.

I purposely got the top level warranty so it covers the gearbox with £10K per claim up to the value of the car, tbh I am being hypersensitive to it as 3 mates (including a car dealer) have driven and none of them said anything.

Was it the black B8 they had?

Anyhow, take it back & start again..

Sometimes it pays to be private, as in my experience Indi dealers don’t honour anything they say

Well I got an email today from them, still only willing to offer buy back but also to asses the damage to back up my claim.

Obviously spoken to their solicitor who told them they don't have a leg to stand on, <beep> that I have to lose my Saturday driving to Milton Keynes and back but may save me £1K in repairs.

Well I can say am now totally blown away, I said OK I will come up on Saturday Morning (as they are open 7 days a week and I work 5) so you can asses the car and request we take the car to an independent garage (ATS, Kwik-fit) so there is no biased to the condition.

Which I think is fair but this reply (reduced down so you don't get bored) is epic

"all 4 tyres are within the legal limit, the report you sent from Halfords shows the wheels are Amber not red so you are just looking for betterment of the car plus that could have happened in your ownership (err it was reported less than 15 hours after I drove away and i don't know of any 24hour wheel refurb companies). If you bring the car down please don't do this at weekends as this is our busiest time and our offer of £200 goodwill is generous enough"

Ring ring....Hello solicitor

Agreed, sounds like even trying to converse with these cowboys is a waste of time. Solicitor route of rejecting the car in return of full refund definitely the best route, on grounds car not as described AND not fit for purpose (advertised with sport pack which it does not have, two wheels buckled, told 5mm tyres)

I wouldn’t even give them the time of day, you have given them a chance and they are just fannying about.

Cheers guys.

So annoying as I am just want to detail it, stick some new tyres on and enjoy it but have to go through this crap.

Really taken the edge off buying a car I have yearned after for 6 years.
