Court summons for speeding - anyone got some experience

Post by klauster » Sun May 03, 2009 11:41 pm

Just wondering what I can expect points and fine wise.

Summons finally arrived. Im going to plead guilty as its just too expensive to fight it. It was an honest mistake, dual carriageway, road was originally 70mph, but changed a week or so before to 40mph and I just didnt see the 40mph start signs (mainly due to very poor signage)

Anyway, in the eyes of the law I was doign 71 in a 40 zone.

I know I was in the wrong now, but I can honestly say it was accidental, I have never before or never will again drive that speed in 30 and 40 zones.

Advice and expectations please.

Court summons, you will be banned. Have a look on Pistonheads and get a barrister ..

You are too far over for 6pts IMO

its a court summons, not a fixed penalty, from what I have read, and people I have spoken to, its more common to get fine plus 6 points, i will be getting a solicitor involved this week

In my opinion when it gets to court, all bets are off.

I got nicked doing 57 in a 30 (recently changed from a 40 to a 30) and went to court.

Technically, I think they could have banned me but had a chat with the court clark...first offence, responsible job and all that...

She did her bit with the honourable gentlemen and I wound up with 4 points and £150.

Were there any warnings of the impending speed limit change? I believe they need to provide adequate notice of a change and cannot make an instant change. Hope this helps and good luck.

basically no, the red signage was spray painted out, waiting for a new ped crossing to be finished.

funnily enough, even now, I drive that stretch of road most days, and people still do 90 on it, thats how bad the signage is!

I suggest you send a pm to gareth215 on this forum who might provide some clarification to the legal aspects around the visibility of signage?

That might help you decide if hiring a specialist like mr 'loophole' Freeman.

90... DOWN THAT ROAD!!!!!!!!

deserve to get banned. A copper was banged up last week for hitting a kid at 70 on a 30 mph stretch with no lights or sirens on and killed that child.

if folk are daft enough to do 90 on a ring road especially where there are new pedestrian crossings going in then they either have titanium knackers or plain f'ing irresponsible and folk like that screw up the law for the rest of us by having more and more stealthy speed cameras erected.

Good luck in court!!!! you'll need it!!

SWMBO received summons on Friday for 62mph dating back to early November. Agree with you about the poor signage, I checked this morning and the 40 sign on the right is obscured by the various other signs until you are about 20 yds away, which doesn't seem great when approaching a busy roundabout on a 70mph dual carriageway. The 40 signs would have been better situated after the roundabout IMO. The reduction from 70 to 40 doesn't seem to have been noticed by most people, as you say. Hoping for up to 6 points and a fine, but guidelines seem to allow for a ban of between 7 and 28 days as alternative to points.

Your RANT is OTT.....
in his original post he explains it was a genuine mistake, recent change for national spedlimit to 40 with poor signs... and he was doing 70(national speedlimit) not 90.

So in summary get off your high horse quattrokid1 :bash:
