I think the ECHR are totally wrong too, but they have established a legal precedent and whether that's right or wrong that is the current case law.

In every other area you are not required to incriminate yourself, so why should motoring law be different? It shouldn't, it's a breach of Magna Carta - which is the basis that makes English Law different from most European (Napoleonic) law and which the ECHR don't understand.

I have been through all this, its horrible having to wait to find out what will happen!

I was caught doing 110mph on a dry quiet dual carriageway at night, i got 6 points and a £350 fine. Obviously the conditions etc helped, but i still think its down to the magistrate on the day, so fingers crossed for you! GOOD LUCK.

My lad(19yrs old 106 gti) in court recently,
69 in a 40
3 points already for 97 on mway
still in 2yr probationary period for new drivers

He got a solicitor £345
letter from employer to say his job was history if he lost his licience
outcome was 14 day ban plus £220 fine inc costs :lol:

I was done a few years ago doing 106mph on the A303 (those of you who know it know it just invites a heavy right foot). Pleaded insanity with a large helping of dementia on the grounds of diminished responsibility, the world would self implode and we’d all disappear into black hole that would annihilate the universe if I lost my licence.

I got 28 days ban and £500 fine.

The whole event was very odd, the court was in Andover and there had been a big disturbance in the town the night before. The main court was dealing with the after affects so they heard my case in a primary school classroom. It’s hard to keep your face straight when the magistrates are sat on chairs made for 5-yearolds surrounded by finger paintings.

im currently awaiting a hearing in October, following getting caught doing 71 in a 40mph. Dual carriageway, recently changed to 40 from 70, poor positioning of new speed limit change. I pleaded guilty with 'special reasons' - the signage (I have the photos) Got a socilitor which has cost me £600 so far. I am expecting to take it up the tailpipe, possible ban, and large fine should they find me guilty... :(

Normally a ban would only apply if you are doing twice the speed limit, heard this from a court official.

He was telling a "porkie pie" - I know several people who have been banned for doing just over 100 in a 70 limit, that's nowhere near twice the limit.

Yes i agree, but the guidelines for doing over a 100 are a ban as well,i'm talking about up to and including the 40 limit

I'm told 30mph over the limit is the tipping point no matter what the spead is......so I'm told

I got 60 day ban and 500£ from Rotherham magistrates 10 years back for doing 109 on the M18. At least the licence comes back with just an SP50 and no points :?

OK I've been biting my tongue for the last day, but here goes ...

I reckon your lad SHOULD have lost his licence and had to retake his test. He was caught twice within his first 2 years of driving, once doing 27 over the limit and once doing 29 over the limit. The first 3 points was his warning, and he chose to ignore it. Given that the death and injury rate is at it's highest amongst young drivers he needs to learn while he still can, and the inconvenience of having to scrounge lifts or use public transport should have been part of that learning.

We ALL speed and I'm no exception since I've got 3 points for doing 41 in a 30 limit in April 2008, but we take heed of the warning and take more notice of our speed when driving.

Ito have been holding my tongue too.

I am not angle i was done doing 106mph in a 70 zone at midnight on a notoriously bad bit of road for speeding 4 years ago. I employed the powers of a solicitor, whom is a friend and fellow rs owner.The outcome was a SP30 28 day ban and £400 fine plus £450+vat solicitor bill, so all in all about £1/mile!!

We all speed yes, sometimesilly speds at times but whilst doing these speeds our observation and reactions should be hightened and more alert to road signs, markings, junctions etc are these are the vital bits of information thatlet us judge what may happen.

I am sorry you have been done for speeding and yes in my opinion ,as a civil engineer that spends a lot of time both on roads and constructing them, the sign according to your pictures does appear to be obscured (but surely there were standard 3,2,1 cout downs) but the fact there was a pedestrian crossing there should have been a give away!

My best advice is get a solicitior local to the court you have been salled to, as they will no doubt know the judges that stand in the court and maybe able to pull some strings to reduce the speed you were doing by say 2mph which willmake a diffrence.

Following my ban i chose to undertake the IAM advance driving, have already held an RAC motorsprts licence( so not a do gooder), to "test" my self tomy perception and observation skills andit amazed me how much you take for granted and by looking at the road markings, signage, and surroundings etc the information that you actually have before pressing the loud pedal.

Any way good lucky with your case but the best i think you are looking at is 28day ban . Advice on that,, go on holiday for 2-3 weeks, also your ban only counts in this country so you can drive overseas.
