Cancelled order: Audi declines a refund on deposit

Cancelled order for my RS4 Avant last week for two reasons:

1. Audi didn't honour the Contract Hire quote and changed to 'offer' to a 40% higher one.
2. The car would arrive Mid October, not Mid August and Audi Basingstoke failed to offer a solution for keeping me mobile during those months (my old leasecar has to go back mid August).

Offered Audi to pay the car outright to avoid point 1 and asked for offer on point 2. But again no reply.

I cancelled now but since Audi took that long to sort things out, they claim the car is now confirmed as build (and spec) and they say they will only refund my deposit if and when they sell the car... :audibash:

What should I do ?

- Press ?
- Court ?
- Audi Customer care (are they ANY usefull ?) ?

Call Customer Service and ask when the ordered was confirmed. If the date was a good time after you cancelled they you may have some ammunition. But you need to have a letter or something dated when you cancelled the order.

If not, then do all 3 you mentioned and also burn the place down.

They seem to be taking the p1ss with the Avant orders, they are getting later and later - even the cabs are here now but still no Avant.

I cancelled AFTER the buildslot was confirmed.

But they never gave me a confirmation until it was confirmed (as far too late) and they also only told me the conditions of the lease would be very different AFTER having confirmed the buildslot...

Which is a pretty :evil: technique as you wait to give the customer bad news until the buildslot has been confirmed and then say 'thank you' for the deposit...

Hold on, I take it you have the original contract hire quote?

If so they don't have a leg to stand on, they either honour the original quote (not going to happen) or they cancel the contract, it is they who seem to have broken the agreement not you.

Defintiely seems to me like they have not got a leg to stand on if they've changed the contract. As well as the other suggestions - give trading standards a try - they can be really good with this kind of thing, and generally a call from trading standards will make most rogue traders and twats <beep> a brick and pull their fingers out.
