Herts and Beds Transmissions - AVOID!

Post by Joshie » Tue Aug 10, 2004 9:24 am

Some of you may remember me having my S4 gearbox repaired by Herts and Beds Transmissions way back in January 2003. There was a twisted input shaft, which had been replaced at a labour cost of £688 plus parts.

Six weeks later I discovered why the bill was so low as the gearbox was literally hanging off the back of the engine on loose bolts incorrectly fitted by the incompetents at Herts and Beds Transmissions. The result was a blown turbocharger which AmD made good with a new pair of turbochargers (replacements need to be fitted in pairs) at a cost of £2500.

Although Ian Gibbins the MD who met Scott Evered and me at AmD’s premises back in February 2003 readily admitted liability when he inspected the engine and gearbox (which had been removed from the car as a unit by AmD) when it came to time to pay up Herts and Beds refused. Yesterday, Monday 9 August 2004 after numerous delaying tactics by Herts and Beds Transmissions the case finally came to conclusion with a hearing at Milton Keynes County Court.

The evidence was overwhelming and the judge found in my favour for the £2500 plus costs. However, the judge refused to accept that Herts and Beds were in breach of contract for the £688, which I was also claiming. I thought that was a little unfair but that’s British justice for you – the judges decision is final. Nonetheless I am delighted that justice has been done and relieved that this long running dispute has been brought to a close even if it did cost me a fair few bob to win the case it was worth every penny.

Classic lines from the case:

“Does the S4 have a 6 speed gearbox – I don’t know” Ian Gibbins MD H&BTL

“I’ve never seen the manual before (from the official Audi manual for S4 gearbox removal)” Ian Gibbins

When the judge declared H&BTL incompetently refitted the gearbox Ina Gibbins replied:
“Can’t argue against that”! :knob:

So a word of warning if you need gearbox work give Herts and Beds Transmission in Baldock, Herts a very wide berth indeed. I wonder how many cars there are running around with loose gearboxes on them!!!

And of course not forgetting a HUGE THANKS to Scott at AmD for coming along to court to give evidence. :beerchug: :jump_clap:

Well done Joshie. Are there any garages/workshops out there that people trust?

I think it would be good to have a section where you can post writeups on outfits who
have worked on your car (along with prices).

And AMD, I know a lot of people here are really into AMD. Myself, I have been a few times
and really just treat them as an expensive garage (i.e. I just view their work as
getting what I am paying for, nothing special). I have to say though that it was
outstanding of them to do this for you.

This whole experience over the gearbox made me realise one thing - cheapest is not always best and in many cases it is actually the worst option. If AmD had removed and refitted my gearbox there would have been no problem at all. That is a fact. I know the work would have been first class and worth every penny in terms of reliability and peace of mind.

Never again will I let "any old fitter" work on my car. Companies like Herts and Beds Transmissions are the worst sort - not only incomptetent as was proven yesterday in court but stubborn and pig headed when it comes to admittting and putting right their mistakes.

No Johnny - AmD are so much more than an expensive garage and that old addage "you get what you pay for" could never have been more relevant to my sorry experience.

Herts and Beds

I had a similar problem with them when my gearbox needed rebuilding on my Saab they're original quote was not the same as the total bill surprise surprise! And then when the car was delivered back to me the speedo was not working and I had to take the car to a Saab dealer who diagnosed it as a problem with the box so then the car had to go back to herts and beds for another 2 weeks before it was fixed.

They are a nightmare!!

Good result Ian, probably the best you could have expected.

I didn't know you were trying for breach of contract. Although it was worth a go, I'm not surprised the judge refused because he had already accepted the consequential damages.

So have all your costs been awarded? I hope that you don't have any more trouble getting Gibbins to pay up.

Hi Dave - well apparently he was actually covered by insurance after all so I shouldn't have any problems there but we'll see.

Regarding the breach of contract my solicitor felt that this was a clear breach but the judge didn't agree.

Small claims only covers about £230 legal costs but I got a couple of hundred for an expert witness and the court fees plus interest so I didn't do too badly.

Just glad its all (almost) over

The one I had a ride in last time I was in MK. The car that is so fantastic with the best engine ever made in this or any other universe.

But I gather from Paul's post that you have a different car now???
