tyre tread legal limit??

Post by JJmac » Mon Jul 16, 2007 6:36 pm

does anyone know what exactly the legal limit is for tyre treads ? I thought it was at least 1.6mm across 3/4 the face of the tyre.
The cop who stopped me yesterday thinks different, and im looking at 3 points cause my tyre has 1.4 mm in the middle(centre tread)which only accountes for about 10% of tyre face but ok either side,
the fact that i was clocked at 104mph overtaking an M3 didnt help matters either.
the b@stard stopped me and not the bmw who was easily on the tonne mark aswell. I have to take the speeding points but i think i can argue the tyre condition.

Also - road angels.... - im thinking its probably a good time to invest in one , do they work for radars tailing your car aswell as in front of it , thats how i got caught out.

Tread Depth Law:

Current tread depth legislation requires that car tyres must have a minimum of 1.6mm of tread in a continuous band throughout the central ¾ of the tread width and over the whole circumference of the tyre.

So looks like you will have a prob defending. :(

As for laser detection, all they do is let you know that your speed has just been checked, apart from the garage opening device covered before on here.

Road Angels will warn you via GPS of fixed camera locations. Laser detectors are for all intents and purposes a waste of space as they will tell you that you have been pinged...and that is too late. MCB's point is valid though.

As far as the speeding goes, since you are at that speed it'll be a court appearance and probably a ban. I'd suggest you get a decent solicitor involved. How did the cop measure your speed? My guess is that he used vascar - a decent solicitor may be able to pull the case apart. Nick Freeman has an advisory service and expert solicitors http://www.freemankeepondriving.co.uk.

I'd suggest that you get the tyres measured by a reputable garage NOW as this can form part of your defence. Make sure they state the make and condition of the tyres as well as the tread depths.

Might also be worth having a look at the UK Driving Secrets guide http://www.uk-driving-secrets.com/beat for inspiration.

Is this any good in your opinion?

I got a copy of it, and it has quite useful advice which you might consider using if defending yourself or if the solicitor you use is not as knowledgable about motoring law as Freeman.

Contains stuff about general motoring law, speeding (and detection devices), calibration and training requirements, parking etc. Helpful advice includes "remain silent" - i.e. don't say anything that may incriminate yourself, never produce your documents at the roadside when asked by the old bill. Be aware that speeding can cost you up to £ 1,000 + ban (on normal roads) and £ 2,500 + ban on motorways.

It comes either as a paper boom or electronic format for the pc.

Interesting - why not produce documents at the roadside?

Thanks

It says in the "book" that if you are stopped for (say) speeding and the officer asks you for your documents, producing them will be seen as an admission of guilt. You do not have to carry your documents and you have the right to produce them up to 7 days later at a police station.

It's an odd one I admit, but that is what it says!

Worth trying I guess (although hopefully won't find myself in the situation!)

The last time traffic police tried to stop me on the M1 in their Vauxhall Omega, they never saw me for dust again. It was late at night and the roads were nice and clear. They tried the sneak, stealth approach after I shot past them sitting on the chevrons between the merging junction and the main motorway doing 110mph. When I clocked them it was too late. They waited for me to get out of view as if they hadn't seen me then they tried to run upon me. Blower however recognised their xenon lights and stepped it down.

My way: If doing over a ton and it is viable for a clean getaway, go for it, and I don't give a monkey's nut if folks are disgusted, the whole system is corrupt. However, if stopped I suggest you do not sign any documentation because that declares to them that you are who you say you are, you agree to the charge(even though you may have marked that you want to contest it) and that you agree to provide the relevant documentation within the specified period they give you(if asked).

So you see that you have shafted yourself already and you haven't even got back into your car yet. Alot of folks don't realise that you do not have to sign any paperwork they give you at the road side.

You could always contest the reasons for the 70mph speed limit being in place and whether they are applicable to your case. For example, if you are caught doing 30mph on a 20mph road at 1am in the morning(20mph being put in place say because of a school on that road), you could easily contest that the reason for the speed limit cannot apply to your case since there are no school children around at that time. Also because of that time, the roads would be very clear.

So many tricks can be pulled out, even in the court one can pull a number a cards( not stepping in the box, standing in the corridor to answer you case- therefore the judge has no jurisdiction over you, not contracting with the court by refusing to give your name and address and date of birth- when they ask you for these things it is a contract you are making with the court and hanging yourself, repeatedly asking questions for the questions you are asked, declaring that you do not understand the charges(for if you state you do, that is another noose around your neck and another contract) declaring that you are a "Natural Person" and that the "Person" or "Defendant" Or "Respondant" is not you(big difference between a "natural person" who is real flesh and blood as apposed to a "person" who is "artifical" better known as a coporation.

These tricksters called the government have really shafted the people with all their tricknology and dodgy parliment bills and solicitors take advantage of this and fail to inform their clients of the "Full" truth.

Full pelt all the way. That Omega got creamed. The Volvos aren't too hot either. These new BMW diesels though are a bit more potent but unless they've got an M3 or an M5, don't even think about it with Blower or many other cars on this forum.

A mate of mine is an advanced instructor for the Met (he trains the instructors!!) and they use unmarked 535d's ... often see them in this neck of the woods playing cat and mouse at stupendous speeds. I've told him I'd come out and play one day....se if he can keep up.
