My RS5.... Dealer sold me a damaged car !!!

Just found out today my 2011 RS5 has been involved in an accident and had some previous bodywork repairs. I've had the car for about 6 weeks and it was purchased from a main AUDI dealer in Yorkshire, name and shame later !
The car went into Cheshire Oaks Audi yesterday after waiting a month for an appointment with a courtesy car ! I had a fault with the Advanced Cruise Control not working whatsoever since owning the vehicle. This was the closest dealer to me in Manchester who has the necessary equipment to carry out the job (it had been into Manchester Audi who referred me to them).
Upon further investigation the technician has found that there has been bodywork repairs to the front bumper, OS wing, bonnet and headlight (appears all items have been replaced). Consequently, due to the bad repair, the work is not covered under the warranty and as a result the radar unit cannot be align due to ill fitting, brackets missing and bent bumper bar !
As you can imagine I am not a happy bunny and I am awaiting a call back from the used car Manager... Anybody know my rights and give any recommendations ? I am looking to return the car due to misrepresentation etc etc.

'Caveat empor'
They don't have to tell you if the car has been repaired.
You don't have any proof when the car was damaged, who fixed it or anything.
As such you can't not assume or prove at the moment the dealer has deliberately miss sold the car.
Ask local audi dealer and/or customer services the history to see if you can find out if an audi dealer repaired the car.
Remember - if it was an insurance job it is highly unlikely that the insurance company used an audi dealer.
Might be worth asking insurance company I they can trace the previous insurer to track down the original repairer - the warranty for the repair would be with them if any.
However this isn't all bad... Depending on when you purchased the car.
The failure of the radar cruise control 'may' be covered user the sale of goods act and / or dealer warranty.
The grey area with the sales of goods act is that it could be considered reasonable to test the cruise control on a test drive (what speed can it be used? Does the car allow the cruise control on and tr radar fail or does cruise control failed completly?)
Remember - the sales of goods act is not a warranty.
Regardless if your personal feelings on the rights and wrongs do not under any circumstances speak to the dealer guns blazing and angry. You need to work out something and you need to expect a bit of give and take on both sides. If you come across as reasonable you are FAR more likely to get a better outcome.

Just Re-read six weeks since purchase. That does give you leverage but remember it is not all in your favour.

Sorry to hear this,you should take the car back to the "AUDI MAIN DEALER' you bought it from and TELL them you want it fixing you've only had it six weeks if they refuse get in contact with AUDI UK and ask them is this common practice that AUDI MAIN DEALERS sell cars that are not working properly and refuse to fix them im sure you will get this resolved as youve only had the car six weeks ,keep us posted.

Yeah the repair carry was not up to Audi standard and when I took it to audi in Cheshire they refuse to fix it under warrantly because the work was so shoddy. I ask if they would have sold me this car, they reply was different dealer have different standard (so be warn)and no was the reply. I was a bit naive to think and Audi approve car was the cream of the crop and that why I (we) pay a premium on them. Maybe now whenever I buy a car over 30k I should get it independently check.

I wouldn't buy a 30k car without pressing every button.
Does the cruise control work at all or is it just the radar?

I've just been having issues with a car and after a call to Audi UK my situation has been resolved wonderfully. They were truly brilliant. I started off frustrated but then acted reasonably and they bent over backwards to help me (with the dealerships I must add).

By far the best advice - just be reasonable and don't start off shouting and issuing demands and threats.

If the tech has ticked points 99 and 132 on your multi point check you could argue the car wasn't pdi'ed correctly as additional ammunition.
99 - check under body for damage
132 - check driver assist functions

Going to speak to the general manager on Monday. Think they going to replace it ... So might get the facelift RS 5 but with less spec..and funny u should mention the 145 point check... They Never give me one???

Check sheet should be in the docs in the handover.
You sound to have done very well - depending on the circumstances you could have been screwed.
In the broader scope if you'd bought from an independent then they could have claimed it was not broken at the time of purchase. Most inde warranties are 30 days so you would t have been in a strong position.
Next time press and test every button. I take a notepad with me with a checklist of everything I can think of to check. It's far too easy to get caught up driving a great car like the rs4 and forget that it's a used car.

Hi,
That's a shame, you must be gutted.
A friend of mine has just had a full refund on his A3 S line black.
He had owned it 11 months and it was due a service, he took it to Sheffield Audi who told him the car had been in an accident. He kicked off at Manchester Audi ( where he bought it from ) saying the car would have never passed its 145 point check when he bought it.
Full refund within 3 weeks.
If your not happy then stand your ground.

Story so far...
General manager suppose to ring on Monday morning, but a salesman rang instead at 5.30 pm to say that general manager wasn't in work today and that the used car manager would be dealing with the matter.
Tuesday, the same salesman rang just before 7.00pm to say he been very busy and that he be dealing with this and he'll be the go between for the manger, and could I email the report Cheshire oak Audi sent us....
Are they taking the pi$$ or I'am I imagining this..
Never known such bad customer service b4
