Cambelt - what happens if it fails b4 4yrs/40k

Don't worry, it hasn't happened yet - touch wood...
I've been trying to ascertain who pays if your cambelt breaks at lets say 36,000m when you were told it should be replaced at 40,000. Also assuming that you had it replaced 3yrs, 6mths ago. So, in theory, within the recommendation both on time and distance.
So, from what I've read, "they" (wasn't sure who, but seems to be garage? but maybe they claim from manufacturer) only seem to cover failure on these for 2 years...
Does that mean, it goes KABOOM, and Mr Audi goes, that'll be £16k please... Or does someone who a) made the belt, b) fitted the belt, c).... pays for the whole lot to be fixed?
If we are at risk, surely changing just before the 2 years expires is best, or take out insurance on it (guess a warranty would cover the above situation, but not everyone has one).
Anyone know the actual legal stance here?
