There is of course the argument that the car hogging the outside lane actually caused the fellow to put pedal to the metal. I've done it myself - cruising along at 85 leptons and then some idiot (and yes, they are idiots because half the time they do it deliberately) just sits hogging the outside lane whilst not overtaking anyone and causes one to become frustrated so much so that when they do eventually move over, we boot it out of frustration. So I may stretch the old girl to say 120 leptons for a second or two before settling back to the 85 leptons I was happily at before. It's sods (no, not sod), make that f*ck-off's law (because it does f*ck you off) that you get caught at that precise moment.

I have twice defended doing over 100mph. Some years go, but the argument was the same. I was an area Manager Blah Blah. On the first event I had free RAC legal cover, by the time the lawyer had finished with my story, even I was in tears. The first one was a £200 fine and 3 points the second time the Magistrate asked me if £100 and 3 points was OK. It is a lottery and depends how the magistrate feels at the time. I beleive our RS6's are restricted to 155mph i wonder what would happen if they caught you at that sped

I got caught doing more than 115mph at night on a dual carriageway. The police said they could not catch me (but did not put their lights on) so backed off and caught me later up the road when I had slowed. You can't fight the old bill, they gang up like herded sheep. I have not met very few that are not out on a power trip. If you were breaking the speed limit near a school at finishing time, fair game. But the law needs to be applied within the environment it is enforced within otherwise we get into a complete nanny policed state. In my case all the electrical equipment in the police car had failed (so no recording or vascar etc), so they checked the speedo accuracy with a laser gun at night. Both police officers statements were word identical - all 2 pages of it....coincidence or a photocopy?
I got 6 points and a £1500 fine. My solictior told the court that it would hurt me more if I were to get a heavy fine without loosing my license. That worked for me and the government as I do voluntary work and would have quit had a ban been imposed.

This makes me angry. They need evidence. Period. This should never have held up in court and a good brief would have got you off. If there is no video evidence then they have no case. End of. And the business of saying they couldn't catch you was bull as well. If the top speed of the old-bill cars is 155, then their story doesn't hold water either. I would agree but in the end there were 2 police officers statements stating I was travelling in excess of 115mph (when they backed off as I was pulling ahead so quickly). In this instance it is then a straight fight between them and me, who will the court side with? Remember that before electrical gadgets, this is how speeding motorists were caught.
What they did omit from the statements was they first started tailing me at 80mph in the outside lane about 3 car lengths back. Then I slowed to approx 65mph as I was nervous a car was tailing me it was only then when they did not pass me that I nailed it and this all happened in darkness at night.
This was about 5 years ago but none the less, knobers the lot of them.
I did make a formal complaint the next morning, stating that when I was doing 80mph I was breaking the law. The response was comical...."driving cars is their bread and butter, they are doing it because they enjoy driving fast, that is why they waited to see how fast you would go..." A rash of 4 letter words escaped my mouth and I was invtied to leave the station. Ho-hum.

From my experience so far there are some fairly simple rules of thumb they seem to follow on motorways:
- 70-80 - they wag their finger at worst!
- 89-90 - they pull you over, but if you are contrite (and providing the conditions were safe etc) they caution you
- 90-100 - they will give fixed pen notice (and a bollocking!)
- >100 - they throw the book at you.
I make copious use of my cruise control to sit where I won't get points!
Comments in past two years when on hard shoulder have included "Your lane discipline was excellent!", and "just how big IS the engine in there sir?".
They aren't all bad blokes, and even if they are, eating humble pie is the only sensible strategy.

Well, I am feeling better now that I know Im not the only one out there who has had a foolish moment here and there. Im not a very aggressive driver, but I have had my moments, the finger jesture was more about making a point that sitting in the outside lane like that is not acceptable, nor of course is steaming past at 101..But as soon as I had I would have pulled back into the correct lane like I always do, just the luck of the draw as will be the court appearence and the beak in the furure, we'll see.

Agreed (despite the current 'no exuses' patrols programme. I got pulled last year by a traffic car in Poole. Followed me for 3 miles at less than the speed limit before coming along side and waving me off the dual carriageway.Daveperc wrote:.

All they wanted to look at was the car and to ask what it was like to drive. They were in a C6 S6 and were keen to compare. Turns out in the end they were the same guys i met at the airfield run where i hit 189mph.

I've been watching this thread with interest as I too have recently been nabbed by the Old Bill for exceeding the 70 limit.
Heading up the A30 out of Cornwall at a fair old lick on a nice sunny day with minimal other traffic about I spotted a marked BMW patrol car leaving the dual carriageway by the off ramp ahead of me, Half a mile down the road and I see him again flash the blues as he pulls out to overtake somone in the slow lane.
As I'm doing well over the limit I slow down to less than 70.......................
He then tails me for a Mile or so and pulls me over.
As we settle down in the patrol car for a nice chat He asks me how fast I was going and of course I say "just keeping up with the flow of traffic contstable and probably about 70 - 80 or so" He say "we wouldn't have bothered to pull you even if you were doing 90 but we recorded you at 102.35 MPH............
I said "I'm would be surprised if I was going that fast but certainly hadn't noticed" he then said there was then a possibility they could nick me for driving with undue care and attention.

They always ask you how fast you were in the hope that you admit to it. Makes it much easier to prosecute you. You gave the right answer.
