I would try and use that against them then.
I feel gutted for you but can't see how you will get anything, those brushes should be banned really.
I was very lucky to get money back when a specials board fell over in my local pub car park and smashed the screen, damaged the wing and door on my first car. Even though there was a sign saying ''park at own risk'' the board hadn't been chained down in very windy conditions. The owner of the pub chain said it was lucky it was just a car that had been damaged.
Got my car repaired and they paid for it.

This is very true, you have to remember that most people will use the same brush to clean the bodywork, then clean the mud off their tyres and wheels, so the amount of crap that those brushes must collect would make you sick. I have seen off-roaders cleaning the caked mud off after a green-laning session, more than once.

Although I sympathise heavily, I don't think you have a case as they have no control over the condition of the brush each time.

Well, i took Tesco`s to the small claims court, then today they have done a out of court setllement for the damage on my car, it just goes so show, don`t let these big guy`s walk all over.

i remember when the <beep> from customer service phoned me and told they they will not pay and that their decision is final. Well Mr <beep> now eat your words...sorry had to get that out.

Good result - well done! Was it the court summons that made them settle or did they leave it until the day before the hearing?

The court hearing wasn`t until October, but the mediation service contacted us both yesterday to see if it can be sorted without going to court, and Tesco have now agreed to pay for what i`m asking for. Im my opinion this is better, as if this went to court the judge could of sided Tesco then i lose.

Good on ya. I suspect Tesco didn't want to go to court for fear of setting a precedent if they lost. Think of the claims that would pour in if that hit the headlines!

To be honest i didn`t want to do it from the begining, but it was the atitude of the Tesco customer service man that phoned me from the start, He was 100% that Tesco would not pay out, But as they never sent anyone one round to inspect the car as such, i thought go for it,

p.s Phil, i did make sure that they are not going to pay me in reward points.
