so your insurance co would not pay invoice cost even though car was under a year? or they did byt the gap insurance said they should get a new car and then it got messy> sorry for being a bit thick on this.

This was my confusion, but if I understand correctly the path Insurers follow if they offer new for old (under 12 months) is they offer a brand new like for like replacement, which is what happened to me back in 2002 when my TT got stolen. I guess the issue is they don't offer to settle with a cash alternative equivalent to the cost of a new car.
Still don't see the point of GAP though for year 1 unless you don't want your car replacing with another one should it be stolen.

My Gap was with MAPFRE and it states in their small print that " if a replacement is offered and it is rejected then nil benefit is paid" but nowhere did it say that there is a time span to which it must be replaced by. But it turns out that it has to be completed within 12 weeks which they don't tell you until you lose your mind as I did.
So basically Paul you are right that GAP could be useless in the first year if you don't mind having the exact replacement cause the insurance cover that bum hole but in my case I was only fortunate enough that the wait was 16 weeks and finally after a load of ear bashing they spilled the beans.

Most insurance companies will respond to a positive approach to close a claim. At the end of the day successful closure and customer retention is generally their goal.
Try and get them to explain the low-ball number you are looking at (they don't pay VAT etc, they get a significant discount due to their hidden buying processes and volumes). In the case of a car like this and it also being quite young then it is not really difficult as they cannot talk about "mileage and condition" as soft elements to reduce the price.
Once you know where they stand then if you are interested in amending the spec of the car and paying the difference you can use their purchasing strength to get a better deal. I have done this with some HiFi in the past. If you let them do the buying then they re happy as they can follow their own rules in minimising spend on the resolution. The more you fight them the slower it goes.
Aviva in particular have a generally good reputation if you let them lead and ask for "guidance" in this way. I have no association with them but have been a customer in the past. There is almost endemic "enhancement" of insurance claims in many areas of the U.K. resulting in quite strong process enforcement in their business these days. The day a new iPhone is released the number of the older model that are dropped is staggering.

Apparently Mike no they don't. They only pay used car price. It's barmy I know and that's why I lost my head.
I even took it right up to the head of complaints department in the end with the ins.

Sometimes trying to get an answer out of an insurance company is like talking to a brick wall
August 2016 would - touch wood - be ten years no claims for me. I'd like to know which insurance companies will declare 11, 12, 13 etc years no claims on their paperwork, and which just cap no claims at 10 or 10+. However, I think I would be fighting a losing battle trying to answer this question communicating with an insurance companies call centre

And to update all. Collected my new car today. I can put the past behind me and enjoy my new baby daughter and my new SQ5. Thanks everyone for all the support that you've all given me over the last month.
