Reading the sections quoted above ... "competent and careful driver". Now doesn't that give you the opportunity to question how competent and careful the two witnesses are? Many cases can revolve on discrediting the witnesses. If the two witnesses have less than perfect driving records then how can they be the judge of "competent and careful"? Obviously when you made the manoeuvre you were confident of the abilities of both yourself and the vehicle to make that manoeuvre safely. You, yourself are a competent and careful driver .. had it not been for the diesel spill the accident may never have occurred.

As I said before - arguing the case in court costs money that I don't have.

Justice only exists if you have the money to get your solicitor to explore all the avenues before fighting a potentially lengthy (read expensive) trial. I have niether the money nor the stamina to undertake such a fight. I am still not back to full health and I tire very easily.

I am left with little option but to cut my losses and plead guilty.

why not set up a fund for this sort of thing..if every member donated a pound that could help alot and maybe see the right outcome when this sort of thing happens..

Case adjourned until 12 May for pre-sentencing report by probation service. The Magistrates are accepting jurisdiction over this, so it will not have to go to Crown Court at this stage.

Probably best that I say nothing more until sentence is handed down.

They didn't feel that they could pass sentence without the report so mitigation was irrelevant at this point. It will be put forwards at the next hearing but much of it will be likely to appear in the pre-sentencing report in any case.
