Summons on the way for allegedly texting

Visit from an offish officer tonight saying at a specific time and road today he saw me using my phone,I explained i have hands free but wasnt using it anyway,he then said i was texting gesturing someone holding a phone in a low position,i asked how he could see through my door if i was texting like that,He just said me and my pertner saw you why else would i write down your registration? at which point he showed me my reg written on his hand!!!!!!!! 1 WASNT on or using my phone and have my proof on its way in the post,what do you guys think? Im furious at his manner right from the off and blatently admitted because he says i have done it i will be prosecuted,what would you guys do?

if you can prove that you were not using your phone with your phone records,then ask him to prove it in court .... mean while tell him to go forth and multiply with his partner!!!!
obvoiusly got nothing better to do with thier time then!!

I can prove it without question,the whole thing doesnt feel right,ive signed nothing and dont even know the officers name or station he works from,I get the feeling this is for something else they cannot prosecute me for!! Can they really just decide to club together and say you were doing something you werent??????? Will i loose in court if i plead not guilty? Will i put a bullseye on my back if i take it to court and win? I have several police friends who are sound this guy had an attitude towards me from the off and im questioning what might come if i take him on and win!!!!!!!!!

first, you need to prove your case...if you have phone records it should be easy...
I don't know how it works there, but here he must prove you're guilty, you're assumed innocent...
records should be irrefutable...

second, file a complaint outlining why you think this was personal and vindictive
if you document it, he is more likely to back off

are you saying he approached you several days after the alleged incident?
he didn't stop you at the time?
sounds fishy

then he can't do nothing now! maybe
trying to get a bogus confession out of you.


i have had alot of dealings with the police
over the last few years driving an evo at such
a young age,they'll try anything but without
actually stopping you there and then they can't
do anything.

How do you know they were police?

Don't want to worry you but that was a good way of checking where you live and what you look like.

If they were police they would have cautioned you and issued either a fixed penalty or notice of intended prosecution I would have thought.

I think you should call the real police and tell them you think your house has just been "cased" by bogus police officers and see what they say.

you proving there was no activity on the handset could only prove you didnt send or receive a message.

you could still have been looking at content already on the phone.

if you were holding the device whilst driving, witnessed by two police officers, then they potentially have a case....

wait to see what turns up...then get some advice.

3 points and 60 quid i think worst way...unless it was affecting the way you were driving your vehilce, in which case it could be driving without due car...

IIRC if they do not stop you at the time or have photographic evidence then they have missed their chance..

I had a letterfrom grampian police saying i was seen by two officer in a certain street in aberdeen at a specifc time using " a hand held communications device" . Shame when i turned up to the police hq with a parking recipt with my reg on it in glasgow on the same day and approx same time as i was "seen"!!!

I think the reason they sent a letter was more like i was sitting bang on 15mph (speed limti) on the beach front with an unmarked BMW5 seies hasseling me to go faster so i would get a ticket. Pitty they forget to take of the hi viz vests in the car kinda gave them away!

if youhave proof via phone bill etc, i would ask the police for their proof, but be carefully as if you are correct and proove them wrong then your car will be watched in future campaigns they have!

Did they cop and his pal leave you their shoulder numbers or names??

I have been considering all the points raised by you guys myself,i accept they could argue i was looking at my phone when i prove i wasnt using it,even though i wasnt.His manner was unprofessional and got worse when i clearly wasnt having his accusation.He did check out my track day photos/leathers with shagged knee sliders etc ive had a word with a friend who says they can prosecute after the event,his manner is the most worrying to me,his opening line was can i have a word about something?

He asked for my full name and date of birth surely he would of got this from a check on my car reg?

Why is my no written on his hand and not noted in his book? Why did he come on his own? Ive signed nothing hes issued no paperwork what was his point in coming? Its been a long time since a brush with the law but somethings not right

Are you sure he was a copper, did he show you any ID? It is worth confirming at the station that this visit is genuine and recorded somewhere. It does sound suspicious..

Im starting to question wether he was genuine or not,he didnt produce a warrant card or say who he was,he had full kit on which looked pukka,im not sure how to tackle it,the full thing is iffy and un professional at best and if i go in and ask questions and it is genuine it alerts him to the fact im on it and not daft,im wondering if hes seen me off duty hence the reg on his hand and not properly recorded in his notebook and then when on duty come round to try it on,if hes bogus hes now got all details apart from my signature!!!!!!!! If he came round to put the sh*ts up me its worked!

He stated i didnt see him during the conversation but if he was off duty in civilian clothes i wouldnt would i?
