Sorry to hear this is turning into a b@ll ache for you.

D_K and ads are right on 2 obvious course of action to try to push things along and take you to the next level if that's what it needs, but don't forget that another option would be to get another opinion from another main dealer from a different network / group. The warranty you have is backed by Audi UK, not the supplying dealer, so there's no real reason why they need to deal with it. Yes, this might cause some hassles with the loan car, but simply speaking to the supplying dealer and saying that's what you're thinking of doing might chivvy them along a bit.

I still think this will turn out OK in the end though - just keep your cool as best you can and politely keep chipping away - good luck.

I'd follow D_K and ad's advice. Contact Audi UK, contact the dealer principle and note that unless there is material progress within the next week that you are rejecting the car and expect a full refund.

Then sit back and forget about it, making much use of the S4.

No, stick with the supplying dealer, as they have more reason to do right by you as you are their customer.

And having a 62 plate S4 is a big gesture! Most places would have you in a TDI A4.

I bought the car from five oaks so do I speak to their dealer principle? Or
The car is at Portsmouth Audi for repairs so do I speak to their dealer principle? Or

Sorry to confuse - I didn't realise you've already got a different dealer looking at it than the one you bought from - my bad!

Follow the others' advice and take it up the line at the (servicing) dealer first as it's them that seem to be being slow - they usually have a service manager and then an aftersale manager, then the principle. There's no harm speaking to Audi UK in parallel, but make sure you have had some sort of dialog with the servicing dealer first, because UK will always speak to the dealers if there's an issue that they feel is worth investigating

Might also be worth contacting the supplying dealer (if you haven't already - I may have missed that?) to notify them of the issue, because it's them that you will have an issue with if you decide to pursue a sale of goods act claim

Five oaks are very aware of the situation, I've already spoken to their dealer principle approx two weeks ago and they were the ones who authorised Portsmouth Audi to remove my engine and they would pay the cost of removal if the claim was unsuccessful.

The place that has the car are dragging their ass.

Contact Audi UK. Let them know what's happening, and ask them for some advice on moving forward. I wouldn't bother with the dealer principal at this point. That's who I would have spoken to 2 weeks ago. Not now.

For the record, I've seen this happen to about 15 different Audi S4/RS4s. The assessment generally is done in a week, with a yay or nay from the warranty side. Not a month.

The replacement of the engine can take ages waiting for it to be crated over, then the Shop needs to install it etc. The whole process usually take 2-4 weeks depending on how long the motor takes. You're at 23 days and they don't even know what they're going to do yet.

Your contract of sale is with Five Oaks - they are the ones with the most to lose and who you should speak to.
I know ifs been a long time but still not the right time to go in guns blazing. You have an awful lot on your side and they will know it. All you want now is a nudge from the dealer principle to portsmouth audi to get it moving along.
Ideally it would be good to sit down with the supplying dealer and work out a plan of action, agree some provisional dates and what their intentions are in various circumstances. At all times you need to make sure that you appear that you are willing to work with them.

Finally, given your specific situation that you have alluded to I do think you may look to seek an option for them to buy the car back. You won't get what you paid for it as you have had some use out of it however given the state it's in now and even the best case of getting the car back in 4 weeks it's not going to be doing any favours.
You may even suggest to the dealer that if Audi Warranty cover the repair then you could do a deal such that you will see the claim through and then they buy back the car for an agreed price. Dealer happy as they are not sat with a car they can't fix, you have an easy sale...

No idea just thinking options.

the only advice I'd offer, document EVERYTHING
do what you can in writing (email, fax, etc.), and if you must do it over the phone make time/dated notes of the conversation
I like to follow-up their claims: if they say 2 weeks, send them a note confirming " per our convo of xxxx you stated the car would be ready in 2 weeks"

this may prove helpful down the road
