Section 59 is a joke, there were better ways of fixing the "problem" - but they went for something that limits the freedom to defend yourself (again). These type of laws will *always* end up being used in situations that they weren't intended for and I'm not sure I even blame the police at all - they have a job to do and will inevitably use the tools(laws) which are available to them - the problem is the law makers. So, who appoints the law makers? hrm...

I was in the Lotus yesterday (trying to learn to love it more than I do right now) and out for a spirited drive. I come over a hill on a familiar B road and I've lifted off the gas as it's blind but lucky I had done - there was a marked police traffic car reversing onto the main road in front of me. Any faster and I might have been into the back of him. He stopped as soon as he saw me come over the ridge, I braked then made a point of using the oncoming carraaigeway to go around him and carried on my journey with him becoming a dot in the mirror - I had given him a 'What the hell, buddy!' type look on passing. I carry on with my 'spirited' drive when 30 secs later, traffic car in the rear-view. So I sat then at the national speed limit for the next 10 miles with him behind me - he had nothing on me, clean license. When i eventually got bored of that I came off at an exit to see if he'd follow - he didn't so i came back on again and sat behind him for the next 10.
Thing is that these officers are young nowadays - my father was a Police traffic officer for 37 years and left the force at 54, his partner, Jim, was a similiar age, both firearms trained and just exceptionally professional. They knew that if you gave someone a light wrist slap and explained what they'd done wrong it was better than a fine/ticket for all people generally. I just feel that the Police can be provocative nowadays and, also, that the traffic officers don't seem to have an interest in cars anymore. Then again there are some pretty horrible people around that the police have to deal with, can't be nice.

There's nothing quite like a road side bollocking to make you see sense. Funny, it's a completely different feeling. I've never had a ticket but a couple times when I thought I'd been "got" it's hard not to feel instantly angry and pissed off. However when you've got a reasonable uniformed officer making quite a clear point that "sir has been a bit of a tit" you just feel 10 years old and stare at the ground mumbling "sorry sir", "yes sir" "won't happen again sir".

Sorry I haven't posted back sooner, but as you can imagine I've had a pretty busy day trying to squeeze a days worht of work in before having to run halfway across the country to get there before 4:30.
Anyway all done now and she is back home where she belongs, only stopping for a quick clean on the way.
Thanks for all your advice. It ended up costing £150 for the recovery fee plus £20 for a days storage so it cost more than I was orignally led t obelieve so a bit annoyed at that. Plus I still have to somehow get back there to collect my other car that is still parked close to the recovery place.
Anyway all done now and she is back home where she belongs, only stopping for a quick clean on the way.

Mike I hope you gave it a good Italian tune on the way home, with a bit of undertaking on the motorway+ maybe a bit of tailgating thrown in for good measure

LOL, there was plenty of opportunity on the way home being the middle of traffic hour on the M1; inside lane almost empty, middle lane almost empty, outside lane packed full of cars bumper to bumper and braking! But, I was a good boy on the way home. I was more worried about the journey there in the Alfa as I had to peg it to get there on time but I was careful to not exceed the speed of any other cars (well not a lot anyway). I would have been sooooo pee'd off if I got that one confiscated on the way to get the Audi. I'd have never lived that one down! The officer yesterday actually said to me that I was really unlucky to get caught as he'd spent all day at the station doing paperwork so had only just got out and due to staff shortages there were very few police about.

There's no way they should have taken your car away, end of story, having been harassed as a teenager on my motor bike on a regular basis, surely you only need one seven day wonder each week, even my dad wrote a letter of complaint about harassment, I'm afraid there's no love lost with the police in my mind.

I had this when i was about 18. i did get stopped in my RS6 about 3 months ago. undercover, gave me a talking to and i was on my way, he even had his sargent in ther car who checked my details. sound as a pound if your calm.

Oh dear that is not good! I had a section 59 a few years ago! The good thing is they only last 12 months! He then had no choice other than confiscate my car! So my car is now impounded and I couldn't get it out tonight as they were closed so best I can do is go get it tomorrow. I have 7 days to collect otehwise it gets crushed, although he did say they don't normally crush cars of any value, its the ones that cost more than the £20 a day storage charge that get crushed as no-one will pay for them to get released after a weeks worth of charges.
Instead of leaving me in the middle of nowhere, he did drive me the 12 miles home and brought my shopping back too which was very nice of him.
So let that be a lesson to you all, slow down!
