Oh my, what a time since my last post on here !!!

Firstly if ive messed up the Euro trip i appolergise, if any cost i will pay !

As you know i live in Spain, i have lots of property here. I had tennents who could not pay there rent, 2K per month. I gave them 4 months at the end of the month they agreed to leve the property, i went in an changed the locks. I got knocked up at about 12pm 3 days later and arrested for breaking and entering in my own property. !! I went to court where i got sentenced to 18 months in prison !!!! Ive just got out on friday on appeal !! Aparently because they had a 12 mionth contract possesion of the house goes to them and ive had to give them the keys back to the house evewn though they still cant pay !! I now have to take them to court to get them out of the house, even though they are back in england !!! What a joke !!!

Anyway im back in my RS4 and happy !!!!!!

its un real out here, they just sentenced an 76yo couple to 23 months for changeing the lock on a tennent who wasnt paying !!! The consulate is about as helpfull as a heater in the dessert and will only get involved when you are sentenced, then all they really do is make sure you have propper medical and dental rights whele inside !! On the up side, my spanish has improved and ive lost about 1st !!!

How to Evict a Tenant who is not Paying the Rent

Non-paying tenants have become a real problem for landlords who rent out their Spanish property, a problem which seems to have been aggravated after August’s credit crunch. While the first thought of a distressed landlord is to lock the tenant out, or shut off the utilities, this is considered illegal by the Spanish Authorities and may lead the landlord to face criminal charges plus the payment of compensation to the tenant. If trying to reach an amicable agreement with the tenant fails, the only feasible option left to a landlord is to start an eviction process through a Spanish Court of Justice. Although the Spanish authorities have promised to enact a new ruling next year which will reduce the eviction time to only two months, currently an eviction of a non paying tenant takes anything between 10 to 18 months (typically one year).


The loss of rental income during this period of time can leave the landlord in bad financial shape, and things may turn uglier if the rental is partly being used to pay off a mortgage: if the monthly payments are not met, the bank could repossess the property. A horror story that many a landlord can be faced with.

What to do

The first signs of warning should be triggered once you’ve verified your tenant is two or three weeks late in the rental payment. With no delay, the first step will be to send the tenant a registered letter (“burofaxâ€

since you own so much property don't you have a lawyer or have encountered this situation before, non-paying tenents?
I know of no civilized country where you can just change the locks...you can't be judge & jury...they have rights
say the landlord gets a higher offer and just wants to toss them out?
say the landlord is getting paid but raised the rent contrary to the terms and they didn't agree? lock them out?
say there is a dispute about payment...they paid, your bank lost it, there are issues with apartment, leaks, no water, etc. and they are withholding rent until rectified...they put it in escrow


John, somehow I feel with you we'll never get the whole story, lol
